These terms are an agreement between you and John Kusion ("we", "us") covering your use of the OnMyWeigh iOS app. By downloading or using the app you agree to them. If you do not agree, do not use the app.
Read this section even if you skip the rest.
OnMyWeigh is a self-tracking tool. It is not a medical device, and nothing in it is medical advice, diagnosis or treatment.
Always consult a qualified healthcare professional before making decisions about your weight, diet, exercise, medication or health — particularly if you are pregnant, have an eating disorder or a history of disordered eating, are under 18, or have any medical condition affected by weight.
If you are struggling with your relationship to food, weight or your body, please seek help from a professional. Weight tracking is not appropriate for everyone, and it can be actively harmful for some people.
We grant you a personal, non-transferable, non-exclusive licence to use OnMyWeigh on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, redistribute or resell the app.
Some features require OnMyWeigh Pro. Pro is offered as an auto-renewing monthly subscription, an auto-renewing annual subscription, or a one-time lifetime purchase. Current prices are shown in the app before you buy and on the App Store listing.
All purchases are processed by Apple, not by us.
If Pro is unavailable, features that require it are locked. Data you created while Pro was active is never deleted if a subscription lapses — measurements, milestones and targets remain on your device and become visible again if Pro is restored.
We cannot issue refunds. All purchases are made through Apple, and refunds are handled solely by Apple under its own policies. Request one at reportaproblem.apple.com.
OnMyWeigh stores your data only on your device. We hold no copy and cannot recover anything for you.
You are responsible for keeping your own backups. The app can export your data as CSV, JSON or PDF at any time. If you delete the app, reset your device, or lose it without a backup, your history is permanently gone.
Do not use OnMyWeigh unlawfully, attempt to circumvent its purchase or licensing mechanisms, or use it in any way that interferes with other users or with Apple's services.
We may add, change or remove features, and may stop publishing or supporting the app. We will update these terms and the effective date above when they change materially. Continuing to use the app after a change means you accept it.
If we discontinue the app, data already on your device remains yours and the export features continue to work for as long as the app runs.
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, error-free, or that its calculations are accurate for your circumstances.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or health outcomes, arising from your use of the app.
Where liability cannot be excluded, our total liability is limited to the amount you paid for the app in the twelve months before the claim.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Apple is not a party to these terms and has no responsibility for the app or its content. Apple has no obligation to provide support for OnMyWeigh. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. If you are a consumer in the EU or UK, you keep the protections of your local law.
